The Cushing® MLP High Income Index (collectively, the “Cushing® Indices”) are designed, calculated and published by Cushing® MLP Asset Management, LP, a subsidiary of Swank Capital, LLC (“Cushing”). The Cushing® Indices are the exclusive property of Cushing® and are protected by applicable intellectual property and other laws. The non-exclusive right to use one or more of these indices as underlying for OTC (e.g. derivatives, swaps, warrants, etc.) or exchange tradable products (e.g. ETNs, ETFs, UITs, closed-end funds, etc.) is granted only upon completion of a license agreement. You may not develop or create any product that uses, is based on, or is developed in connection with any of the proprietary material (including proprietary indices) available on this site without the prior written consent of Cushing.
